That does seem early!
Sid, can I encourage you to report the sighting to Butterfly Conservation NE - they have a recent sightings page which alert other interested people to the fact that some species are on the wing: http://www.northeast-butterflies.org.uk/sightings.html

Turns out is not so unusual to see an adult small tortoiseshell - but this one has definitely woken up early:

Butterflies such as Sm.Tort, Peacock, Comma, Red Admiral, overwinter as an adult and can be seen anytime of the year if weather is warm. We get records as early as 1st January for these species.
